My belongings were sold w/out my permission; can I take it to small claims?

I left my belongings (e.g. Musical Instruments, clothes, Cd‘s etc..) with my brother about 9 months ago so I can move out of state with the verbal agreement to have them shipped to me. Come to find out that he recently sold my belongings in a yard sale without my permission. Can I take this to small claims – and what kind of case would I have? What evidence would the judge need from me?

I don’t know what the laws are in your state, but items left nine months might be considered to be abandoned. That does not make what your brother did right, but it might make it legal. You might want to see if you can get a legal opinion before you go to court.

If you do go to court, you might well be hurt that you don’t have any agreement in writing.

No matter what happened, your relationship with your brother is damaged. I hope it’s not beyond repair.

It might just work out better if you asked him for the money he got for your things and then just let it go. That does not mean you’ll store things with him again.
